Sorry it never occurred to me that a menu system wouldn't work right if it didn't contain the active item. Since I've NEVER encountered that before in the 7+ years I've used Joomla / Mambo. I had no reason to search for that, the searches I did do returned zip for results so I posted.
I use several menus on any given page, what you've just told me is that their effects won't work right if the menus don't each contain the active page as a menu item. That makes maximenuCK totally useless to any site that requires multiple menus on the same page.
This is good to know, it means I should move on and find a better solution.

only the fancy effect needs an active item as it focus on it
for all other behavior the menu works fine even if there is no active item
if you wan to change colors on active or hovered items you can use css
