MaxiMenu and Article title

I need to display article titles. Some of them trade mark symbol with them.

Therefore, I am using something like this on the article titles - Product & trade ; which gives me Product™

Which seems to work - except if the article is displayed via CK Menu than I see Product & trade ;

I was wondering if there was a way around this.

are you on joomla 2.5 or 3 ?
is it working with the native joomla menu module ?

I am using joomla 3.x - just test it, no - it is not working with native menu either. Maybe I am slightly mislead as it is displaying perfectly within 2J tabs - both as a tab header and within the tab content.

Puzzled.
